The National Industrial Court in Lagos has nullified the September 16, 2025 election of the Petroleum and Natural Gas Senior Staff Association of Nigeria (PENGASSAN) Chevron branch and ordered a fresh poll within 30 days.
Justice Joyce Damachi, in a judgment delivered on August 10, 2026, directed the South-West Zonal Director of Labour to supervise the fresh election.
The court also declared invalid the dissolution of the Chevron Branch Executive Committee and the caretaker committee appointed by PENGASSAN’s Central Working Committee.
It upheld the validity of the branch’s bye-laws and declared their revocation by the union’s national secretariat invalid.
The court further set aside the September 2025 election and declared all offices and actions arising from it null and void.
Justice Damachi held that PENGASSAN’s Central Working Committee failed to follow the association’s constitutional procedures before dissolving the elected branch leadership.
The judgment followed a suit filed by seven members of the Chevron branch challenging the dissolution of the elected leadership and the September 2025 election.
The court also awarded N1 million in costs against PENGASSAN.
