APC challenges Atiku’s substituted service request on Tinubu

The All Progressives Congress has challenged an order allowing Atiku Abubakar and the African Democratic Congress to serve court processes on President Bola Tinubu through the party’s national secretariat.

In a letter to the Federal High Court in Abuja, the APC argued that the substituted service was unnecessary because Tinubu’s lawyers had already obtained the court documents, filed his defence and served it on the plaintiffs.

The suit, filed by Atiku and the ADC, seeks to challenge Tinubu’s eligibility to contest the 2027 presidential election, citing an alleged discrepancy between the name on his NYSC discharge certificate submitted to INEC and his official name.

The APC said Tinubu’s legal team obtained certified copies of the court processes on September 11, filed a preliminary objection on September 14 and submitted his defence on September 15.

The party said both documents were served on the plaintiffs’ lawyers before the September 16 order permitting substituted service was granted.

The case is before Justice Inyang Ekwo, with the matter adjourned to September 28 for further proceedings.
